AN AGREEMENT, made this

day of

between the GOVERNMENT OF THE BRITISH CROWN COLONY OF HONG

KONG (hereinafter called "the Government"), of the first

part, and RADIO CORPORATION OF THE PHILIPPINES, a corporation

duly organized and existing under the laws of the Philippine

Islands (hereinafter called "the Corporation"), of the second

part:

With regard to the working of a radio telegraph service between the radio telegraph station of the Government

in Hong Kong and the Corporation's radio station near Manila,

Philippine Islands, WITNESSETH that

It is hereby mutually agreed between the said

parties as follows:

I. Each of the contracting parties undertake to

hand over, unless specially ordered otherwise by senders, to

the other party, all the radio telegraphic traffic exchanged terminally between Hong Kong and the Philippine Islands with-

in its control.

It is understood that the foregoing provision does

in no way prevent the said stations from handling radiograms.

from or to places beyond the Philippine Islands or the Crown

Colony of Hong Kong.

II. The basic radio rates, classes of traffic

admitted and the places from or to which radiograms may be

dispatched shall be specially agreed upon between the

contracting parties.

III. The rates applicable to radiograms transmitt-

ed between the Government's Hong Kong station and the

Corporation's station near Manila, Philippine Islands, shall

comprise the Government's terminal or transit tax, the

Corporation's terminal or transit tax and a basic radio rate.

The basic radio rate shall be considered as that

amount which remains after deducting the terminal and transit

taxes and all "other line" outpayments beyond the Government's

and Corporation's terminal zones from the through rate.

The terminal and transit taxes and all "other line"

outpayments shall be credited in full to the party to whom

they are due.

On traffic transmitted between the Government's

Hong Kong station and the Corporation's station near Manila,

Philippine Islands, one-half of the basic radio rate shall

accrue to each party.

IV. The contracting parties agree to adopt all

reasonable measure within their power to have their

respective installations so improved as to permit reliable

and regular direct service between the Government's Hong

Kong station and the Corporation's station near Manila,

Philippine Islands.

V. The contracting parties agree to transmit

between their respective stations mentioned in this agreement

the telegrams of the British Government, the Government of

the Philippine Islands and the United States Government,

at one-half the radio rate.

VI. The settlement of accounts between the

contracting parties shall be made quarterly, and the basis

of settlement shall be the gold franc, balances to be

remitted through a medium mutually agreed upon.

VII. In the execution of the service the

contracting parties undertake that the provisions of the

International Telegraph Convention of St. Petersburg and

any modifications thereof shall be applicable by analogy, insofar as they are not contrary to the provisions of this

agreement or to any provisions of any International

Convention to which the governments of Great Britain, the

Philippine Islands and the United States of America shall

be signatory parties.

VIII. The contracting parties also undertake to

maintain their respective stations in good condition and

to conduct through same an efficient service for the handling

of the said traffic at all times, except between such hours

daily as shall be mutually agreed upon between the

contracting parties.

IX. This agreement shall continue in force for

a period of ten years from the date on which it has been

signed, and thenceforward until six calendar months' notice

to determine the same is given by either party to the other

in writing.
